NOTICE IS HEREBY GIVEN: That default has occurred in the conditions of the mortgage dated November 14, 2002, executed by Michelle R. Dalluge and Michael R. Dalluge, wife and husband, as mortgagors, to TCF National Bank, a national banking association, as mortgagee, recorded in the office of the County Recorder of Wright County, Minnesota, on December 18, 2002, as Document No. 822606, which mortgage conveyed and mortgaged the following described property, situated in the County of Wright and State of Minnesota, which property has a street address of 10077 Park Place Drive, Monticello, Minnesota 55362, and tax identification number 155125003010:

That the original principal amount secured by said mortgage was $174,173.00; that there has been compliance with any condition precedent to acceleration of the debt secured by said mortgage and foreclosure of said mortgage required by said mortgage, any note secured thereby, or any statute; that no action or proceeding has been instituted at law to recover the debt remaining secured by said mortgage, or any part thereof; that there is claimed to be due upon said mortgage and is due thereon at the date of this notice, the sum of $178,895.30 in principal and interest.

WASTE WATER TREATMENT FACILITY DEWATERING, ENERGY EFFICIENCY, HEADWORKS AND MISCELLANEOUS SITE IMPROVEMENTS

Notice is hereby given that the City Council of the City of Monticello will meet in the Council Chambers of the City Hall at 7 p.m. on Monday, October 8, 2012 to consider the making of improvements to the City of Monticello’s Waste Water Treatment Facility (WWTF) located at 1401 Hart Boulevard.
Improvements under consideration include the removal and replacement of biosolids dewatering equipment; removal and replacement of older equipment with more energy efficient equipment; relocation of the headworks facility, including larger wet well; and miscellaneous site improvements including removing and repaving existing bituminous pavement sections on several internal accesses, driveways and pathways. All improvement options are pursuant to Minnesota Statutes sections 429.011 to 429.111, and include other necessary appurtenant work.
The estimated costs for the improvements range from $15,000 to $6,200,000, depending on which improvement options are approved by the City Council. Portions of the improvement costs may be assessed to significant industrial users.
A reasonable estimate of the impact of the assessment will be available at the hearing. In addition, a reasonable estimate of the total amount to be assessed and a description of the methodology used to calculate individual assessments for affected parcels will be available at the hearing.
Any person who desires to provide comments with reference to the proposed improvements will be heard at this meeting. Written or oral comments will be considered.

CITY OF MONTICELLO
WRIGHT COUNTY, MINNESOTA
AN ORDINANCE AMENDING TITLE 10, CHAPTERS 3 AND 4 OF THE MONTICELLO CITY CODE, KNOWN AS THE ZONING ORDINANCE, BY AMENDING CHAPTER 3.7 (F), FREEWAY BONUS SIGN DISTRICT AND CHAPTER 4.5 (H)(7) PROVIDING FOR REGULATION OF SIGNS USING LED (LIGHT EMITTING DIODE) ILLUMINATION IN THE FREEWAY BONUS SIGN DISTRICT
THE CITY COUNCIL OF THE CITY OF MONTICELLO HEREBY ORDAINS:
Section 1. Chapter 3.7(F) is hereby amended by adding 3.7(F)(4) to read as follows:
(4) LED Illumination
In the Freeway Bonus Sign District, unshielded LED (Light Emitting Diode) illumination may be used pursuant to the regulations found in Chapter 4.5(H)(7).
Section 2. Chapter 4.5(H)(7) is hereby amended to read as follows:
(7) Illuminated Signs
Illuminated signs shall be shielded to prevent lights from being directed at oncoming traffic in such brilliance that it impairs the vision of the driver and may not interfere with or obscure traffic signs or signals. Lighting may not illuminate any adjacent properties, buildings, or streets. Notwithstanding this provision, LED (Light Emitting Diode) light displays may be installed without shielding of the light source provided that:
(a) Unshielded LED light displays may only be located on properties within the FBS, Freeway Bonus Sign District, an overlay zoning district as defined in Chapter 3.7(F) of the Monticello Zoning Ordinance.
(b) Unshielded LED lights are not installed in any area that abuts residentially zoned property;
(c) Unshielded LED lights are not installed in such a way as to direct light toward residentially zoned property within 500 feet of the light source.
(d) Unshielded LED lights may not exceed a maximum illumination of 5000 nits (candelas per square meter) during daylight hours and a maximum illumination of 500 nits (candelas per square meter) between dusk to dawn as measured from the sign’s face at maximum brightness;
(e) Dimmer control. Unshielded LED lights must have an automatic dimmer control to produce a distinct illumination change from a higher illumination level to a lower level for the time period between one half-hour before sunset and one half-hour after sunrise.
Section 3. This Ordinance shall take effect and be in full force from and after its passage and publication. Revisions will be made online after adoption by Council. Copies of the complete Zoning Ordinance are available online and at Monticello City Hall.
