WEST 7TH STREET EXTENSION ((GOLF COURSE ROAD (CR 39) TO MINNESOTA STREET)) AND ELM STREET (7TH ST TO SOUTH TERMINOUS)

TO WHOM IT MAY CONCERN:
Notice is hereby given that the City Council of the City of Monticello will meet in the Council Chambers of the City Hall at 7 p.m. on Monday, April 22, 2013 to consider the making of street improvements to West 7th Street between Golf Course Road (CR 39) and Minnesota Street and along Elm Street from 7th Street to where it terminates to the south.
Improvements under consideration on West 7th Street between Minnesota Street and Elm Street include constructing approximately 1,400 feet of new roadway, constructing curb and gutter, sanitary sewer, water main, storm sewer and bituminous pathway; the expansion of a pond, street lighting and other necessary appurtenant work. Improvements under consideration for Elm Street include bituminous paving of the existing roadway. Improvements under consideration for West 7th Street between Elm Street and Golf Course Road include milling the roadway and completing a bituminous overlay. All improvements are pursuant to Minnesota Statutes sections 429.011 to 429.111, and include other necessary appurtenant work.
The areas proposed to be assessed for such improvements are the properties abutting portions of these street sections and having immediate access to them. The estimated cost for the improvements is $1,443,800. Portions of the improvement costs will be assessed to the properties in the assessment areas.
A reasonable estimate of the impact of the assessment will be available at the hearing. In addition, a reasonable estimate of the total amount to be assessed and a description of the methodology used to calculate the individual assessments for affected parcels will be available at the hearing.
Any person who desires to provide comments with reference to the proposed improvements will be heard at this meeting. Written or oral comments will be considered.

AN ORDINANCE AMENDING TITLE 10 of the Monticello City Code, known as the Zoning Ordinance, by amending Chapter 2.4 –SPECIFIC REVIEW PROCEDURES & REQUIREMENTS
The City Council of the City of Monticello hereby ordains:
Section 1. Section 2.4 – Specific Review Procedures & Requirements, Title 10 – Zoning Ordinance is hereby amended as follows:
2.4(A) – Comprehensive Plan Amendments
(4)(b) City Council
The City Council may hold a public hearing on the amendment if they deem such necessary or it is deemed necessary by the Community Development Department. After consideration of the Planning Commission recommendation and/or hearing, if applicable, the City Council may adopt the amendment or any part thereof in such form as it deems advisable. Approval of an amendment shall require a majority vote of all members of the City Council except for amendments which change all or part of the existing classification of a zoning district from residential to either commercial or industrial which will require the approval of four-fifths of all the members of the City Council. the approval of two-thirds of all the members of the City Council, except as may be exempted by State Statute.
Section 2. Section 2.4 – Specific Review Procedures & Requirements, Title 10 – Zoning Ordinance is hereby amended as follows:
